These Terms of Service ("Terms") govern your access to and use of the MutualFile website, applications, and services (collectively, the "Services").
The Services are operated by MutualFile LLC (to be formed) ("MutualFile," "we," "us," or "our").
By creating an account or using the Services, you agree to be legally bound by these Terms.
If you do not agree, do not use the Services.
2. Description of Services
MutualFile provides an online software platform designed to assist users in preparing, organizing, and filing California divorce-related documents.
MutualFile may provide:
- Guided document preparation
- Workflow management tools
- Spouse collaboration tools
- AI-assisted document drafting
- Electronic filing coordination (where available)
MutualFile is a technology platform only.
3. Not a Law Firm — No Legal Advice
MutualFile is not a law firm.
MutualFile does not provide legal advice. No attorney-client relationship is created by using the Services. Communications with MutualFile are not protected by attorney-client privilege.
You are solely responsible for reviewing and approving all documents before filing. If you require legal advice, you should consult a licensed attorney.
4. Eligibility
You must:
- Be at least 18 years old
- Be filing for divorce in California
- Provide accurate and truthful information
You represent and warrant that:
- All information you provide is accurate
- You have authority to submit the information
- You are not using the platform for unlawful purposes
5. User Responsibilities
You agree that you are solely responsible for:
- The accuracy of all information entered
- Reviewing all documents before filing
- Ensuring compliance with court requirements
- Deciding whether to share information with your spouse
MutualFile is not responsible for rejected filings caused by inaccurate information.
6. Spouse Collaboration
MutualFile allows you to invite your spouse to collaborate.
If you invite your spouse:
- They may access shared case information
- They may view financial and personal information
- They may edit certain shared sections
You are responsible for choosing to share information. MutualFile is not responsible for disputes, disagreements, or misuse of shared information between spouses.
7. AI-Assisted Features
MutualFile may use artificial intelligence to assist in document preparation and workflow guidance.
AI outputs:
- Are tools only
- May contain errors
- Must be reviewed by you
MutualFile makes no guarantees regarding AI-generated content. You remain solely responsible for final documents.
8. Court Filing and Third-Party Services
MutualFile may coordinate with third-party e-filing providers.
We do not control:
- Court systems
- Court timelines
- Filing acceptance decisions
We are not responsible for:
- Court delays
- Court rejections
- Technical outages of third-party systems
9. Fees and Payments
Fees are displayed before purchase.
Payments are processed by Stripe.
By purchasing Services, you agree:
- To pay all applicable fees
- That fees are non-refundable once document preparation begins, except as required by law
Court filing fees are separate and are not included unless explicitly stated.
10. Refund Policy
Because MutualFile provides digital document preparation services:
- Refunds are generally not provided once work has begun
- Refunds may be issued at our discretion
- California consumer protection laws apply where required
11. Intellectual Property
All content, software, workflows, branding, and technology are owned by MutualFile.
You may not:
- Copy
- Resell
- Reverse engineer
- Modify
- Redistribute
any portion of the Services.
12. Prohibited Uses
You may not:
- Use the Services for unlawful purposes
- Impersonate another person
- Submit false information
- Attempt to hack or disrupt the platform
- Use the platform in contested or high-conflict divorce situations if unsafe
We reserve the right to suspend or terminate accounts.
13. Disclaimer of Warranties
The Services are provided "AS IS" and "AS AVAILABLE."
We disclaim all warranties, including:
- Accuracy
- Fitness for a particular purpose
- Non-infringement
- Availability
- Error-free operation
We do not guarantee that:
- Courts will accept your documents
- Your divorce will be granted
- Timelines will be met
14. Limitation of Liability
To the maximum extent permitted by California law:
MutualFile shall not be liable for:
- Indirect damages
- Incidental damages
- Consequential damages
- Loss of data
- Emotional distress
- Lost income
- Court rejection consequences
Our total liability shall not exceed the amount you paid to MutualFile.
15. Indemnification
You agree to indemnify and hold harmless MutualFile from any claims arising from:
- Information you provide
- Your misuse of the Services
- Your violation of these Terms
- Disputes between you and your spouse
16. Dispute Resolution — Arbitration Agreement
PLEASE READ CAREFULLY.
Any dispute arising from these Terms shall be resolved by binding arbitration in California.
You waive the right to:
- Trial by jury
- Participate in a class action lawsuit
Arbitration shall be conducted under the rules of the American Arbitration Association.
This provision survives termination.
17. Governing Law
These Terms are governed by the laws of the State of California.
Venue for any permitted court proceedings shall be in California.
18. Termination
We may suspend or terminate your access at any time if you violate these Terms.
You may terminate your account at any time.
Sections related to liability, arbitration, and indemnification survive termination.
19. Privacy
Your use of the Services is also governed by our Privacy Policy.
20. Changes to Terms
We may update these Terms at any time. Continued use of the Services constitutes acceptance of updated Terms.
